New Resolution for Marital Disputes
New resolutions had been passed by the Dubai Government to appoint arbitrators for marital disputes and guardianship issues. The committee is formed for registering the arbitrators in Dubai. For that two personal status judges are appointed who is the head of the Personal Status Department. They work in Dubai Courts.
Moreover, the head of the Family Affairs Section at the Department along with the representative of the Community Development Authority in Dubai will be part of the committee. Furthermore, the head of the department section on marriage will also be part of the committee. The couple who are in a marital dispute is permitted to choose the arbitrator for them. It is done to resolve their dispute amicably. The role of the formed committee is to overview the resolution.
They will ensure the implementation by running written tests and also conduct one on one interviews. They will interview both individuals in the case. They also review the complaints that are launched against the arbitrators. In this, the responsibility of the judge is to instruct the 2 parties involved.
They will also allow both parties to name the arbitrator out of their choice. If the two parties show reluctance, the judges will appoint the arbitrator. The judges will do it from the registry. A noteworthy point is it is significant that any of the spouses has a relationship with one of them. This will make understanding the situation easier. The duties of the arbitrator are to have a vivid understanding of the case.
Furthermore, there should be attempts made to bring back the spouses together on one page. Reconciliation is the ultimate motive behind all the efforts being made. There is a laid down procedure for the marital dispute which must be adhered to. In the resolution, there are various ways to resolve a marital dispute. It is done via mediation or by an adequate settlement.
The appointed arbitrator will fix the first mediation session for the two of them. In addition, he will notify the couple within 7 days before the scheduled date set. The spouse will submit their cases which may include the description of the dispute along with the alleged maltreatment by any of the spouses. The arbitrator is held responsible to facilitate the two parties as much as possible.
