Difference Between Lawyers and Legal Consultants

Many people are still in the dark about the difference between a lawyer and a legal consultant, and they don’t know which one they should consult for their business matters or personal disputes. It’s important to understand the skills of both the professionals as well as their capabilities and the benefits they can deliver to the clients. It will be described as per UAE Law and for the United Arab Emirates.

  • UAE Nationals are just allowed to enter into Court. They are allowed to be called, Lawyers or Advocates only. They can be Labour and Employment Lawyers, Family Lawyers, Civil Lawyers, Criminal Lawyers, Real Estate Lawyers, Wills and Estate Lawyers as well.
  • These Advocates can also be called Legal Consultants. The common name is Emirati Advocates and Legal Consultants or Emirati Lawyers and Legal Consultants.
  • The lawyers from other countries, they are only able to acquire the license, and call themselves, Legal Consultants. These are the expatriates from other countries.
  • Dubai has its own license to practice, as well as Abu Dhabi and RAK. For the other Emirates, just a license from MOJ needs to be obtained after a result.
  • MOJ means Ministry of Justice. (Please check with any Lawyer or Law Ministry for advanced details)
  • Any lawyer can always act as a legal advisor at any given time if they provide off-court advice to their clients instead of fighting for them in Dubai courts, however, if a legal consultant in Dubai or the United Arab Emirates is a foreigner, they cannot practice law in the courts and can only provide consultancies to clients. To become licensed lawyers to practice in federal courts or Dubai courts one must be a UAE national.
  • Therefore an Emirati Lawyer is a lawyer is a professional individual that works advising and representing others in federal courts on legal matters or disputes. They may also be called an attorney, counsellor, advocate, and countless other names with essentially the same function. Furthermore, lawyers can also define a variety of other professional individuals that work in legal backgrounds.

But the most basic requirement for anyone to call themselves a “lawyer” is to have a certified degree and practice training for one year practically. On paper, any individual that has attended a law school and has an accredited law degree is completely qualified to be a certified and working lawyer. The training and education a lawyer receive acts as proof that you have enough training for being recognized as a certified representative that is capable of fully representing a client in court.

Let us throw the light again that, legal consultants, in theory, are lawyers but instead of representing anyone for the court, they advise and sometimes represent companies or important individuals who need expert counsel. Most Legal Consultants in Dubai work by providing their guidance and advice to large companies and organizations when they are confused by confusing legal matters. They also provide intra-business counselling from time to time to help corporations make wise decisions for their development and business practices. These professionals work in a specific line of expertise and usually specialize in particular areas of law. Read More Here about the Fee Structure of Lawyers in Dubai.
